all'interno di questo nuovo dispositivo che sta sorgendo, la sessualità assume un andamento diverso da quello che aveva un tempo. Un tempo infatti, quel che le leggi perseguivano era un certo numero di atti, d'altronde tanto più numerosi, in quanto non si riusciva a sapere bene che cosa fossero effettivamente; ma ad ogni modo erano pur sempre atti quelli contro cui si indirizzava l'interdizione della legge che condannava delle forme di comportamento. Quel che invece si sta cercando di definire ora e che di conseguenza verrà ad essere fondato dall'intervento della legge, del giudice, del medico, è qualcosa di diverso: l'individuo pericoloso. Ci troveremo di fronte ad una società del pericolo, con, da una parte, coloro che si trovano in condizione di pericolo, e dall'altra coloro che sono invece portatori di pericolo. Pertanto la sessualità non sarà più un comportamento accompagnato da certe precise interdizioni; si trasformerà piuttosto in una sorta di pericolo diffuso, in una specie di fantasma onnipresente, che potrà entrare in scena fra uomini e donne, fra bambini e adulti, eventualmente fra adulti da soli, e così via. La sessualità diventerà dunque una minaccia presente in tutti i rapporti sociali, in tutti i rapporti possibili fra le diverse età, in tutti i rapporti fra gli individui. E' proprio su quest'ombra, su questo fantasma, su questa paura, che il potere cercherà di far presa, servendosi di una legislazione apparentemente generosa e in ogni caso generale; e grazie inoltre a una serie di interventi puntuali che saranno verosimilmente quelli delle istituzioni giudiziarie appoggiate sulle istituzioni mediche. Si produrrà dunque tutto un regime di controllo della sessualità.
